These General Terms ("Terms") are intended to inform you of your legal rights and responsibilities regarding the access and use of the GLOBAL-TEST website - https://global-test.eu/ (the "Website") including but not limited to the delivery of information through the Website.

Please read these Terms carefully.

By accessing or using the Website, you agree to these Terms and enter into a contract that binds you to GLOBAL-TEST EOOD, a company incorporated and existing under the laws of the Republic of Bulgaria ("GLOBAL-TEST"). Do not use the Website if you are unwilling or unable to be bound by these Terms.

  • You use the Services. In this case, You understand and agree that GLOBAL-TEST will treat the use of the Services as acceptance of the Terms.

GLOBAL-TEST EOOD is the commercial company providing the Services through the administered Website.

"We", "us" or "GLOBAL-TEST" refers to GLOBAL-TEST EOOD.

GLOBAL-TEST https://global-test.eu/ is a web- and mobile-based platform on the Internet, owned by GLOBAL-TEST EOOD, a company established and existing under Bulgarian legislation, with EIK 831650573, with headquarters and management address: 1700 Sofia, Prof. Georgi Bradistilov St. No. 4, fl. 2, office 2.1, subject to these General Terms and Conditions.

User

"User" or "You" or "Your" refers to you as a user of the Services. User is someone who accesses or uses the Services for the purpose of sharing, viewing, publishing, transacting, uploading information or viewing images and includes other persons who jointly participate in the use of the Services, as well as any unmentioned services offered by GLOBAL - TEST EOOD on the Website.

Services

"Services" are any and all services that GLOBAL-TEST EOOD can offer to the User through the Website.

"Content" shall include (but is not limited to) images, photographs, audio, video, location data, 'places in the area' and any other form of information or data.

GLOBAL-TEST can provide a translation of the Bulgarian version of the Terms into other languages. You understand and agree that the translation of the Terms into other languages would be solely for your convenience and that the Bulgarian version should govern your relationship with GLOBAL-TEST. In case of inconsistencies between the Bulgarian version of the Terms and any of the translations, the Bulgarian version should take precedence.

  1. CONTENTS
  • Responsibility for Your Content
    • You are responsible for the content you post. You are responsible for all risks associated with the content you post, including the possibility that other Users may rely on its quality, accuracy, reliability or fidelity of information. You represent that you have the necessary competence to post the content. You cannot claim that you have posted content that is in any way motivated, sponsored or endorsed by GLOBAL-TEST.
    • You may be held liable if, for example, the content you post contains material that is false, intentionally misleading, or defamatory; violates the rights of any third party, including copyright, trademark, patent, trade secret, moral right, privacy, right of publicity, or any other intellectual property or proprietary right; contains material that is illegal, including hate speech or pornography; damages to minors; or violates or advocates the violation of any law or other legal regulation.
    • If Your Content is a review, You represent and warrant that You are the sole author of such review.

USER REVIEWS DO NOT REFLECT THE OPINION OF GLOBAL-TEST

  • Use of Your Content

By publishing your Content, you irrevocably grant us a permanent, irrevocable, non-exclusive, royalty-free right to use the published content in the territory of the European Union. This right includes the right to sub-license and transfer.

By "use" we mean using, displaying, distributing, modifying, translating, reformatting, including in advertisements and other works, promoting, creating derivatives.

You grant us the right to use Your name or a username that You submit in connection with Your Content. You irrevocably waive any claims and claims to moral rights against us or brought against us, third parties or our and their users in connection with Your Content.

  • Threaten, harm, harass others or promote discrimination;

When a certain action is not explicitly mentioned in this clause, but clearly violates the rules of Art. 7, it should be broadly interpreted in favor of GLOBAL-TEST, and this action should be considered included in this clause.

These General Terms and Conditions are invariably linked to the Privacy Statement of GLOBAL-TEST EOOD, which controls the collection and use of your personal data, as well as all related rights and obligations.

  1. THIRD PARTY WEBSITES AND CONTENT
  • The Services may contain, or you may be redirected from the Website to, links to third party websites ("Third Party Websites"), as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software and other Content owned by or originating from third parties ("Third Party Content"). Such Third Party Websites and Third Party Content have not been examined, monitored or checked for accuracy, appropriateness, safety or completeness by GLOBAL-TEST and GLOBAL-TEST EOOD is not responsible for such Third Party Websites accessible through the Website or any Content of Third Parties published on, accessible through or installed from the Website.
  • You agree that we are not responsible for access to or Third Party Content on such Third Party Websites. Your use of Third Party Websites is entirely at your own risk.
  1. ADVERTISEMENT

The Services may be supported by advertising revenue and may display advertisements and promotions.

Parts of the Website may contain such advertising information, advertising materials or other material provided to GLOBAL-TEST by third parties. UNLESS EXPRESSLY AUTHORIZED IN WRITING, YOU AGREE THAT, IN USING THE SERVICES, YOU WILL NOT USE ANY TRADEMARK, TRADE NAME OR LOGOS OF ANY COMPANY OR ORGANIZATION IN A MANNER THAT MAY CAUSE CONFUSION AS TO THE OWNERSHIP OF SUCH MARKS , NAMES OR LOGOS.

GLOBAL-TEST MAKES NO PROMISES REGARDING ANY THIRD PARTIES THAT MAY BE VIEWED ON THE WEBSITE OR USERS OF THE SERVICES. GLOBAL-TEST IS NOT LIABLE FOR ANY LOSS OR DAMAGE THAT MAY RESULT FROM THEIR ACTION OR OMISSION, INCLUDING, FOR EXAMPLE, IF ANOTHER USER OR BUSINESS MISUSES YOUR CONTENT, IDENTITY OR PERSONAL DATA OR IF YOU HAVE A NEGATIVE EXPERIENCE WHILE USING THE SERVICES.

PURCHASE OR USE OF PRODUCTS OR SERVICES OFFERED BY THIRD PARTIES THROUGH THE WEBSITE IS AT YOUR OWN DISCRETION AND RISK.

THE TOTAL MAXIMUM LIABILITY FOR LOSSES AND DAMAGES INCURRED BY YOU IN CONNECTION WITH THE USE OF THE SERVICES IS LIMITED TO 100 BULGARIAN BGN.

GLOBAL-TEST SHALL NOT BE LIABLE FOR (I) INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, (II) LOST PROFITS AND ACTUAL LOSSES, (III) BUSINESS INTERRUPTION, (IV) DAMAGE TO REPUTATION, OR (V) LOSS OF INFORMATION. OR DATA.

  1. SETTLEMENT OF DISPUTES
  • You agree that any and all disputes and claims arising out of or in connection with these Terms, the Website or the Services shall be resolved individually without recourse to any form of class action.
  • Any and all claims, judgments and judgments shall be limited to the greater of the monetary value paid by you to GLOBAL-TEST for access to the Website and Services or BGN 100, but in no case attorney's fees; and under no circumstances may you receive compensation for, and each User waives its right to claim, punitive, incidental, consequential or other damages other than the value paid for using the GLOBAL-TEST Services.
  • These Terms, as well as any rights and obligations in connection with them, are governed by Bulgarian law. Any disputes between the Parties arising from this Agreement will be considered and resolved by the competent Bulgarian court.
  1. DIVIDABILITY

If any part of these Terms is found to be illegal, invalid or for any reason unenforceable, that part shall be deemed severable from the rest of the Terms and shall not affect the validity and enforceability of the remaining provisions.

  1. TERMINATION
  • You may terminate the Terms at any time by ceasing to use the Website or by providing GLOBAL-TEST with notice of termination.
  • We may suspend your ability to use parts of the Website and/or bar you from accessing the Services entirely, with or without reason, without notice or any liability whatsoever. Such action would prevent you from accessing the Website, Your Content, the GLOBAL-TEST Content and/or other related information.
  • In the event of any termination of these Terms, whether by you or us, the provisions of Sections 2, 6, 7, 9, 11, 12, 13, 14, 15 and 16 will continue in full force and effect, including our right to use Your Content, pursuant to Section 6.

  • The section headings in these Terms are for convenience only and shall not have any legal or contractual effect.
